In the name of Allah, the All Merciful, the Most Merciful, prayer of forgiveness and peace upon the seal of the prophets, messengers and the followers; callers to the Truth upon clear messages from Allah’s grand Quran..


Oh my beloved ones in the way of Allah, gold is not like canned goods or food stores. If it is not sold, it spoils and expires. If the deceased leaves behind an inheritance; (commercial businesses for buying and selling), this, despite the orphan's wishes, is subject to profit and loss. The orphan has no recourse but to the trustee's responsibility for the profit and loss. They are equal in this regard, and the loss is not calculated for female orphans in the same way as for male orphans; in fact, the loss is calculated for the female orphan as half the loss of the orphaned male, to the fact, the male's share is equal to that of two females, her loss is proportionate to her share of the inheritance, as she receives half the male's share. It is not permissible to calculate the loss equally for everyone. When there is a profit in the business, she receives half the male's profit! This is not justice and fairness, in fact, each person's loss is proportionate to their share of the inheritance. This applies when the deceased leaves behind commercial establishments that are profitable and subject to loss, as they are goods bought and sold, with profit and loss depending on supply and demand. Similarly, with all inheritances (commercial establishments), each heir has a share of the profit and a share of the loss, and their profit and loss are proportionate to their share of the inheritance. Whether the estate consists of commercial establishments or real estate, this is a business of profit and loss in which they are partners. Each has their share of the business estate, and their profit and loss are proportionate to their share of the estate. This is the decisive ruling, and it is not a joke.

But when the father of orphans fears that the guardian is unjust, greedy, and does not fear Allah, then he divides the inheritance during his lifetime before his death. Confirming with the word of Allah the Most High: [Al-Baqarah] 2:182

{فَمَنْ خَافَ مِن مُّوصٍ جَنَفًا أَوْ إِثْمًا فَأَصْلَحَ بَيْنَهُمْ فَلَا إِثْمَ عَلَيْهِ ۚ إِنَّ اللَّهَ غَفُورٌ رَّحِيمٌ ‎﴿١٨٢﴾} ‏صدق الله العظيم [سورة البقرة].

And the reform here with which Allah means: Division of the inheritance should not occur before his death, but rather during his lifetime while he is healthy and well. Surely, he has the right to divide the inheritance among his children so that injustice, disputes, and problems do not arise among them due to his fear of the guardian being a great injustice from among his children or relatives. This is reconciliation among the heirs before a dispute arises among them after his death, even though the guardian is his eldest child, but he feared his injustice and sin. So the right is that he divides his inheritance among them while he is alive and well, or to put each of their shares in the bank in the name of the orphan. There is nothing wrong with increasing the orphan’s share until he grows up, as this is not usury-money, since he put the orphan’s money in a commercial agreement with a small profit. O you who have mercy on the owners of banks and wrong the orphan, then that is indeed an unfair division!

In any case, the most important thing is what guarantees the orphan’s capital until he grows up. But when the money of orphans is intended for (non-banking trade), then this is a trade agreement of (profit and loss).

We continue to commend a great praise upon the generous brother who had the twenty (gold) coins, as the twenty coins were entrusted to him and there was no commercial agreement (profit and loss) involved. It seems that the father had placed it as a hidden trust due to his confidence in his righteous brother while he was healthy and well, and death came to him suddenly. However, instead of giving the orphan his money, due to his young age, the brother invested the twenty coins to provide for them from its profits until the orphan grew up. So here, if the guardian had lost, we would have held him responsible for the twenty gold coins, as it was entrusted to him in full (twenty coins). Even if he had spent on them, we would say: This is the right of kinship upon you, so let him abstain. But he spent on the orphan and his mother for years, perhaps more than twenty gold coins, and returned to them the capital that was entrusted to him. So, by what right does the orphan claim that his uncle has money for him, even though he spent sums on the orphan and his mother and did not count them against the entrusted capital (twenty gold coins), and returned to them the trust as it was (twenty gold pounds)?!

We ask Allah to bless him for his truthfulness; for the fact, it is a monetary trust entrusted to him, with no profit or loss agreement involved. Rather, he must return the trust to its rightful owners (twenty gold coins). This is the definitive statement, and it is not a joke. Confirming with the word of Allah the Most High: [Al-Nesã`a ] 4:58-59

{۞ إِنَّ اللَّهَ يَأْمُرُكُمْ أَن تُؤَدُّوا الْأَمَانَاتِ إِلَىٰ أَهْلِهَا وَإِذَا حَكَمْتُم بَيْنَ النَّاسِ أَن تَحْكُمُوا بِالْعَدْلِ ۚ إِنَّ اللَّهَ نِعِمَّا يَعِظُكُم بِهِ ۗ إِنَّ اللَّهَ كَانَ سَمِيعًا بَصِيرًا ‎﴿٥٨﴾‏ يَا أَيُّهَا الَّذِينَ آمَنُوا أَطِيعُوا اللَّهَ وَأَطِيعُوا الرَّسُولَ وَأُولِي الْأَمْرِ مِنكُمْ ۖ فَإِن تَنَازَعْتُمْ فِي شَيْءٍ فَرُدُّوهُ إِلَى اللَّهِ وَالرَّسُولِ إِن كُنتُمْ تُؤْمِنُونَ بِاللَّهِ وَالْيَوْمِ الْآخِرِ ۚ ذَٰلِكَ خَيْرٌ وَأَحْسَنُ تَأْوِيلًا ‎﴿٥٩﴾‏} صدق الله العظيم [سورة النساء] .
